Lingu is committed to privacy and data security and provide our users with the new rights according to GDPR.

Lingu AS is Data Controller and responsible for the processing of personal information about our customers and users of the websites and learning platforms lingu.no and lingu.com. We are also a Data Processor on behalf of the certain directorates of the Norwegian authorities, such that course participants can participate in and receive documentation for their training through us.

 

WHAT PERSONAL INFORMATION DO WE PROCESS?

We process the following personal information about our customers;

  • Name
  • Address
  • Email address
  • Mobile number

In addition, we store purchase history and behaviour patterns on our website, i.e. information about how each customer navigates on the page.

For our course participants and users of the Learning Portal, we process the following personal information:

  • Identity: Name, national identity number, date of birth and sex
  • Contact information: Address, mobile number and email address
  • Personal learning profile: Educational level, language skills and other skills
  • Login Data: IP address, password and login history
  • Learning Data: We save your activity on our Learning Portal, such as assignments submitted, experience points, comments, time spent, which pages have been opened, and results from different quizzes and tests. 

For job applicants and our employees, we store additional information that is necessary for the employment relationship, such as professional experience, education, documents like CVs, etc., and contact information for the closest next of kin.

 

PURPOSE OF THE PROCESSING OF PERSONAL DATA

We process your information to be able to fulfil our obligations in terms of the agreement with you (or your employer). In order to access our training services locally or online, we need to check who has access to the training.

In order to provide documentation, such as a course certificate, we must obtain personal information about the course participant, including national identity number, in accordance with the Introduction Act for induction programmes and Norwegian language education for newly arrived immigrants.

We also use the information to provide you with information, offers and services by email in connection with your purchase or your participation.

 

THE BASIS OF THE PROCESSING

The agreement with you: personal information that we collect is used to fulfil the purchase agreement. The basis for this processing is Article 6 (b) of the Privacy Regulation.

Consent from you: Where you have given consent, the information will be used to provide you with information, offers and services by email in connection with your purchase. The basis for this processing is Article 6 (a) of the Privacy Regulation. At any time, you can opt out of receiving such information from us.

Legally required processing: Processing of personal data for course participation in Norwegian and social knowledge happens on the basis of Article 6 (c) of the Privacy Regulation.

 

RETRIEVAL OF PERSONAL INFORMATION

We store the personal information you have provided on our web site in connection with your purchase or the information that you or your employer subsequently provided on a digital form.

We use cookies on our website to provide you with the best possible customer experience and service. The Electronic Communications Act requires us to inform our visitors about the use of cookies.

TRANSMISSION OF INFORMATION TO THIRD PARTIES

In order to fulfil our obligations under the agreement (such as customer support), the requisite personal information is provided to our suppliers and partners. All suppliers have a data processing agreement with us that ensures a safe and sound processing of your personal information.

Our suppliers and partners process your personal information in the following cases:

  • when parts of the order include services provided by a third party;
  • when tasks are performed on our behalf and as per our instructions as data processors;
  • when public authorities are entitled to this in accordance with legislation, court decision or enforceable decision by the authorities.

If you do not wish to provide your personal information to us, we will not be able to provide the service you request. It is, therefore, not possible to opt out of this.

 

DISPOSAL OF PERSONAL INFORMATION

If the basis for processing is your consent, you can withdraw the consent and request that your data be permanently deleted from our systems.

Information we have received in connection with your purchase is stored in our active customer account for 5 years.

Information we are required to keep in accordance with the Public Administration Act will be stored for up to 5 years, in accordance with the requirements of the Act.

Information about course participation is stored for 5 years.

For job applicants, we store the application with attachments for 3 years.

 

RIGHTS OF THE DATA SUBJECT

We process your personal information in accordance with the Personal Information Act and applicable regulations. It is noted that you may require access to your personal information, as well as request correction or deletion of information when the basis for our processing is no longer current.

An appeal may be made to the Data Inspectorate for processing in violation of the regulations.

 

 

INFORMATION SECURITY

We secure your personal information using both physical and virtual entry and access control, as well as by encrypting sensitive parts of the information provided.

TERMS OF SERVICE

Please carefully read through these terms and conditions before using our services.

GENERAL TERMS
1.1. These terms and conditions ("Terms") constitute a legal agreement between you, either as an individual or on behalf of an entity ("User," "you"), and Lingu EdTech AS, a company registered in Norway ("Lingu," "we," "us," "our").

ACCESS TO SERVICES
2.1. By purchasing or using our e-learning resources, you agree to these terms. If you do not agree to the terms, you do not have the right to use Lingu's services.

USAGE CONDITIONS
3.1. Users may not use, copy, display, sell, license, decompile, or otherwise exploit Lingu's services for any commercial purposes without express written consent from Lingu.
3.2. Users may not circumvent any technological measures designed to protect the services.

USE IN PUBLIC PROCUREMENT
If the Product is to be used or described in offers to the public or in public procurement, the following conditions must be met:
a. A written cooperation agreement must be made between the Customer and Lingu AS, describing the use of the Product in the specific context.
b. If the procurement requires a commitment from subcontractors, Lingu AS shall sign a commitment as a technical and/or professional subcontractor in the delivery, which shall be attached to the offer. Failure to comply with these conditions may result in the termination of the license.

USER LICENSE
4.1. Upon purchasing our services, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to use the services for your own use.

COPYRIGHT AND PROPRIETARY RIGHTS
5.1. We own or license all copyrights and other intellectual property rights in the services (including all software, text, graphics, images, videos, audio, music, and other materials).

CHANGES TO THE TERMS
6.1. We reserve the right to modify these terms. The latest version of the terms will always be available on our website.

DISCLAIMER AND LIMITATION OF LIABILITY
7.1. The services are provided "as is" and "as available," without any warranties.

LEGAL MATTERS
8.1. These terms are governed by the laws of Norway, and any disputes shall be resolved by the Norwegian courts.

By using the services, you agree that you have read, understood, and accepted these terms and conditions.
